EMPLOYMENT CONTRACT AGREEMENT FOR CARRYING OUT SERVICES. BETWEEN SAINT MECHATRONICS ENGINEERING (EMPLOYER) NEW ZEALAND. & MR MOISES DONGSAL MERINO (EMPLOYEE) PHILIPPINES.
JOB TITLE: STOREKEEPER II (NON EXEMPT)
GENERAL DESCRIPTION OF DUTIES.

You will be responsible for all warehouse operations activities including shipping and receiving, deliveries, coordinating stock, documenting warehouse transactions, maintaining records, and overseeing storage of surplus inventory and property for the District.

Under direction, performs a variety of shipping/receiving, stocking activities; stores and distributes supplies and equipment; maintains inventory and stock records; may serve as a lead worker to other classified staff in the area; and perform related work as required.

Job Summary:
 Receives and inspects all incoming materials and reconciles with purchase orders; processes and distributes documentation with purchase orders; reports, documents and tracks damages and discrepancies on orders received.
 Makes intra- and inter-campus deliveries of requested surplus office furniture and merchandise; maintains records of all deliveries.
 Fills supply requisitions; assists buyer to order adequate merchandise and supplies; delivers orders to faculty and staff.
 Receives, stores, tags and tracks surplus property; prepares property lists for items to be sold at auction.

THIS AGREEMENT is made this 11th day of July 2013, between Employer under the Laws of New Zealand hereinafter called (SAINT MECHATRONICS ENGINEERING NEW ZEALAND). Subject to the following terms and condition
ARTICLE 1: CONTRACT PERIOD The contract period shall be for Contract duration: The contract shall last for duration of 2 years and could be renewed only if employer is satisfied with employee's services. This is with effect from the 12th of AUGUST 2013.
ARTICLE 2: FEES FOR SERVICES AND TERMS OF PAYMENTS 2.1 Shall pay Employees on satisfactory performance Basic salary of the services the sum of NZ$ 4,600 (Four Thousand Six Hundred NZ$ only) monthly. Basic monthly salary for the first 3 month will be NZ$ 4,600
Fixed Salary after 3 months will be NZ$ 5,000
2.2 Shall pay for services rendered by employee by cheque, cash, bank transfer or to an offshore account provided by Employee presented on a monthly basis at the rate stated therein 2.3 The employee will be reimbursed by the employer for reasonable moving expense incurred only as a result of relocation or early termination of leases, storage charges; procurement of travel documents (flight tickets), immunizations etc. Reimbursements shall be made before employees embark on journey not later than Five (5) working days after submission of employee's expense report and receipts, this after

the acquisition of relevant traveling papers through assistance from the Immigrations/Internal affairs ministry in New Zealand. 2.4 Employer shall also take care of employees' travel ticket including that of employees' accommodation only on employee’s early notification to employer and as shall be requested by employee.
2.5 Employee shall work from Monday to Friday (8:30 am – 5:30 pm) with average 1 hour lunch break.
2.6 COMFIRMED EMPLOYEES Confirmed employees are those employee's that have successfully acquired and forwarded his/her necessary permits clearance papers to the employers' management-duly certified by the New Zealand Immigration Services/ Ministry Of Manpower Affairs Of New Zealand). Then they shall be entitled to above benefits.
2.7 OTHER BENEFITS

 You are allowed five (5) days paid sick leave a year after six months in the job, and five (5) days paid sick leave every Twelve (12) months after that.
 You are allowed three days bereavement leave on the death of an immediate family member, or one day of leave where your employer recognizes that you have suffered a bereavement (you are entitled to this after six months in the job)
 Adequate private space in a conducive and comfortable work environment shall be provided for each employee.
 Employees shall be authorized Four (4) times paid vacation during the term of the contract, to be used at the employees 'discretion after duly informing and receiving approval from employer's management.
 Employer will pay Employee's travel expenses (i.e. flight tickets) flat rate travel allowance of NZD $9,820 (Will be deducted from employee salary during the period of contract with employer)

ARTICLE 3: GENERAL ADMINISTRATION AND MANAGEMENT/OTHER BENEFITS
3.1 Unless otherwise stated in a superseding document, the Employer shall maintain general administration and management.
ARTICLE 4: FORCE MAJEURE 4.1 Not withstanding any thing herein stated, neither party should be considered in default in the performance of its obligations under this Agreement as a result of Force Majeure. The term "Force Majeure" shall include but not limited to Act of God, War, Nation wide strike, Lockout, Riot and Civil commotion. A strike or Lockout embarked upon by only the personnel shall not be deemed to be included in this term. 4.2 If an interruption of work occurs as a result of "Force Majeure" for up to seven (7) days, Full Salary will be paid as standby. However, if such suspension results in Employee not being able to perform its duties for more than seven (7) days, then Employer may at its option elect to continue the implementation of this Agreement at adjusted standby rates to be negotiated or to terminate the contract.
ARTICLE 5: TERMINATION 5.1 This Agreement may be terminated: - (i) If the services stated therein are not rendered satisfactorily. (ii) If the duration of the Agreement stated therein expires and no extension has been given. (iii) Under Force Majeure as stated therein
(vi) If Employee fail to comply with the full terms after signing the contract.
ARTICLE 6: DEFAULT OF EMPLOYEE 6.1 In the event of default by employee or non-compliance by Employee with the terms and conditions of this Agreement, Employer shall give notice to Employee specifying areas of default and employee shall have ten (10) calendar days to rectify to Employer satisfaction, the said default(s). If the Employee does not rectify to Employer satisfaction, the said default(s) within ten (10) days of receipt of the notice, Employer may proceed with termination of this Agreement subject only to settlement of all payments due and outstanding at the time of termination. ARTICLE 7: ENTIRE AGREEMENT This Agreement embodies the entire understanding of the parties hereto and any prior representation or arrangements are hereby superseded.
ARTICLE 8: ATTESTATION AS WITNESS, the hands of the duly authorized representatives of the parties, the day and year first above written;
ARTICLE 9: VISA, WORK/RESIDENT PERMIT 9.1 Employer shall process and incur all Employee paper works fee for Visa, Work/Resident Permit Document from New Zealand Immigration Services/ Ministry Of Manpower Affairs Of New Zealand. Employee flight ticket shall be booked by Employer. Note that flight ticket as well as other monetary benefits will be issued to Employee only when Employer have process Employee Visa, Work/Resident Permit Document from the New Zealand Immigration Services/ Ministry Of Manpower Affairs Of New Zealand, where we have signed a contract agreement for easy acquisition of employee traveling document as readiness by employee to join the team.
9.2 Employee will be responsible for the payment of all Couriered Document from the Employer.
This Agreement, executed hereafter pursuant to the same, constitutes the entire understanding between the parties in respect of the matters dealt with therein and the terms and conditions hereof may only be modified, altered or amended with the prior written consent of the party of or parties against whom, such modification, alteration, or amendment shall take effect.
