Appointment Letter
We are pleased to offer you” VICTIM “the position of
REGISTRAR in " Hospital Selesa Specialist Medical Centre" (the "Hospital")
of
address “Lot 498, Jalan Jee Foh 2, Miri, Sarawak, Malaysia“ upon the following terms and conditions:
1 DATE OF COMMENCEMENT
1.1
Your employment will commence on 29th April 2013.
1.2
Your working hours
are Monday to Friday, from
9am
to
6pm. You are entitled to one hour of lunch break every day. You may be required to work beyond the normal working hours
to
discharge your duties at the sole discretion of the Hospital and the overtime which you worked will be duly calculated and paid by Hospital.
1.3
Contract Duration: 2 Years (Renewable after a satisfactory performance)
2 RENUMERATION
2.1
Your starting basic monthly salary will be $ 11,850.00 USD (Eleven Thousand Eight Hundred and Fifty United
States Dollars) /- per Month, exclusive of any taxation (TAKE-HOME SALARY
AFTER TAX DEDUCTION).
2.2
Any bonus
or
declarations of bonus shall be made at the sole and absolute discretion of the Hospital. In
determining the amount of bonus,
the
Hospital shall consider your work performance,
amongst other factors.
2.3
Your performance will be reviewed periodically and the Hospital shall make adjustments to your salary as
it sees fit.
2.4
Family Accommodation: Four-Bed-Room Apartment for employee’s relocating down with their family and
Two Bed-Room Apartment for single employee.
2.5
Transportation (Free Transportation, from home to place of work every day)
2.6
Child daycare assistance.
2.7
Health, dental, life and disability insurance.
2.8
You are entitled to fourteen (14) days of paid sick leave, if you are hospitalized on a doctor's written
order, you may get up to forty-six (46) additional days of paid sick leave.
2.9` Hazard/Inconveniences: USD3600.00 (Monthly), Car Maintenance: USD2500.00 (Monthly), House & Furnishings: USD 4,000.00 (Monthly), Entertainment &
Recreation: USD3000.00 (Monthly),
Travel &
Events: USD5500.00 (Monthly).

2.11
Business
Class
Travel Flight Ticket alongside family travel ticket will be provided by Hospital.
3 OBLIGATIONS

3.1
Perform all duties to the best of your ability at all times;
3.2 Use your best endeavors to promote and protect the interests of the employer; and
3.3 Follow all reasonable and lawful directions given to you by the employer, including complying with policies and
procedures as amended from time to time. These policies and procedures
are not incorporated into your contract of employment.
4 ANNUAL LEAVE
4.1
Besides the gazette public holidays,
you
are entitled to Twenty Eight (28) days paid annual leave; you will receive USD 12,205.00 Take home for each leaves Period. Employer for each Inter-continental trip shall pay USD 4,720.00 flat rate travel/entertainment allowance to employee.
Travel shall be by business class.
4.2
You are entitled to Ten (10) days of compassionate leave per calendar year. Approval for compassionate
leave shall be at the sole discretion of the Hospital.
4.3
All leave applications must be made in writing and at least seven (7) days in advance and shall be
approved at the absolute discretion of the Hospital.
5 TERMINATION AND NOTICE
5.1
Upon confirmation of your employment, either party may terminate the contract by giving one (1) months’ notice or one (1) month's salary in lieu of notice.
5.2
The Hospital, however, has
the
right to give immediate notice before terminating your services
if
you are
guilty of misdemeanour, misconduct, negligence or breach of any of the terms of this Letter of Appointment.
5.3
During your notice period,
you
shall handover all documents
and
materials relating to your work and ensure a smooth transition of your duties
and
responsibilities. If you fail to complete the handover during the
notice period, the Hospital shall be fully entitled to require and compel you to stay two (2) more weeks after the notice period has ended to complete the hand over.
6 CONFIDENTIALITY
6.1
You shall not disclose to any third party any confidential information obtained during your course of
employment unless expressly authorized by the Hospital.
6.2
Confidential information for the purposes of this contract includes and is
not
limited to trade secrets,
business plans,
strategies, financial information and any other information that will affect the Hospital's competitive position.
7 RESIDENCE AND WORK PERMIT / VISA
7.1 Hospital will secure your Residence and Work Permit / Visa from the Malaysian Immigrations Services
here
in Kuala Lumpur, a family Visa will as well be provided if you are relocating down here with your family. This will enable you live and work legally here in Malaysia.
8 REIMBURSEMENT OF EXPENSES
8.1 You are to bear the cost of processing your Notarized Oath statement of Guarantee and Attestation Letter from the Accredited Attorney and Hospital will duly reimburse you of all the expenses you incurred only on sight of
your valid legalization documents to show seriousness in joining the team not later than Five (5) working days after
submission of employee’s expense report and receipts. The First six months upfront salaries shall be paid in
advance before consultants/employee embark on journey to assume duty to enable you take care of pressing needs at your home country.
9 GOVERNING LAW
9.1
Due to the high rise of contract break up in Malaysia, the Government has
made it mandatory that every
prospective employee coming to work for a Malaysian Employer must first secure Notarized Oath statement of
Guarantee and Attestation Letter from
the
Malaysia Crown Court of Justice to legalize his / her contract and to also
state that he / she will honor the terms of contract therein till the end of its duration before the Employer can go ahead and secure the Residence and Work Permit / Visa of the successful applicant; This is coming as a result of

Procurement of the Notarized Oath statement of Guarantee and Attestation Letter will further highlight you have accepted to honor the contract till its expiration; this document is obtainable only at the
Malaysian High Court of Justice through an accredited attorney representing the applicant (Employee). See below

will start the processing of your traveling documents only on sight
of
your Notarized Oath statement of Guarantee and Attestation Letter
from the
Malaysia Crown Court
of
Justice and all
other documents
to show seriousness in joining the team.
I understand that I may voluntarily terminate my employment.
I further understand that I will not be terminated involuntarily at will,
rather it will be with cause or prior notice,

any time, regarding of documents or oral or written statements issued by the Hospital Selesa Specialist Medical Centre or its representatives.
