Letter of Appointment
We are pleased to offer you ”VICTIM “ the position of RESTAURANT MANAGER in "Heritage Station Hotel and Spa Kuala Lumpur" (the "Company") upon the following terms and conditions:
1 DATE OF COMMENCEMENT
1.1 Your employment will commence on 8th October 2012.
1.2 Your working hours are Monday to Friday, from 9am to 6pm. You are entitled to one hour of lunch break every day. You may be required to work beyond the normal working hours to discharge your duties at the sole discretion of the Company and the overtime which you worked will be duly calculated and paid by Company.
1.3 Contract Duration: 2 Years (Renewable after a satisfactory performance)
2 RENUMERATION
2.1 Your starting basic monthly salary will be $ 7,200 /- per Month, exclusive of any taxation (TAKE-HOME
SALARY AFTER TAX DEDUCTION).
2.2 Any bonus or declarations of bonus shall be made at the sole and absolute discretion of the Company. In
determining the amount of bonus, the Company shall consider your work performance, amongst other factors.
2.3 Your performance will be reviewed periodically and the Company shall make adjustments to your salary
as it sees fit.
2.4 Family Accommodation: Four-Bed-Room Apartment for employee’s relocating down with their family and Two Bed-Room Apartment for single employee.
2.5 Transportation (Free Transportation, from home to place of work every day)
2.6 Child daycare assistance.
2.7 Health, dental, life and disability insurance.
2.8 You are entitled to fourteen (14) days of paid sick leave, if you are hospitalized on a doctor's written
order, you may get up to forty-six (46) additional days of paid sick leave.
2.9` Hazard/Inconveniences: USD3600.00 (Monthly), Car Maintenance: USD1500.00 (Monthly), House &
Furnishings: USD 2,000.00 (Monthly), Entertainment & Recreation: USD2000.00 (Monthly), Travel & Events:USD5500.00 (Monthly).
2.10 Communication and Internet Facilities : Laptop Computer, Quad Core Processor, 6 GB RAM, 48XCD-RW, 750GB Hard Drive, Floppy Drive, Integrated Network Adapter, Internal 86K Modem, Spare Battery and Necessary Software’s. 24 hours Internet access is also available.
2.11 Business Class Travel Flight Ticket alongside family travel ticket will be provided by Company.

3 OBLIGATIONS
3.1 Perform all duties to the best of your ability at all times;
3.2 Use your best endeavors to promote and protect the interests of the employer; and
3.3 Follow all reasonable and lawful directions given to you by the employer, including complying with policies and procedures as amended from time to time. These policies and procedures are not incorporated into your contract of employment.
4 ANNUAL LEAVE
4.1 Besides the gazette public holidays, you are entitled to Twenty Eight (28) days paid annual leave; you will
receive USD 6,205.00 Take home for each leaves Period. Employer for each Inter-continental trip shall pay USD 2,720.00 flat rate travel/entertainment allowance to employee. Travel shall be by business class.
4.2 You are entitled to Ten (10) days of compassionate leave per calendar year. Approval for compassionate
leave shall be at the sole discretion of the company.
4.3 All leave applications must be made in writing and at least seven (7) days in advance and shall be
approved at the absolute discretion of the Company.
5 TERMINATION AND NOTICE
5.1 Upon confirmation of your employment, either party may terminate the contract by giving one (1)
months’ notice or one (1) month's salary in lieu of notice.
5.2 The Company, however, has the right to give immediate notice before terminating your services if you are
guilty of misdemeanour, misconduct, negligence or breach of any of the terms of this Letter of Appointment.
5.3 During your notice period, you shall handover all documents and materials relating to your work and
ensure a smooth transition of your duties and responsibilities. If you fail to complete the handover during the
notice period, the Company shall be fully entitled to require and compel you to stay two (2) more weeks after the notice period has ended to complete the hand over.
6 CONFIDENTIALITY
6.1 You shall not disclose to any third party any confidential information obtained during your course of
employment unless expressly authorized by the Company.
6.2 Confidential information for the purposes of this contract includes and is not limited to trade secrets,
business plans, strategies, financial information and any other information that will affect the Company's
competitive position.
7 RESIDENCE AND WORK PERMIT / VISA
7.1 Company will secure your Residence and Work Permit / Visa from the Malaysian Immigrations Services
here in Kuala Lumpur, a family Visa will as well be provided if you are relocating down here with your family. This will enable you live and work legally here in Malaysia.
8 REIMBURSEMENT OF EXPENSES
8.1 You are to bear the cost of processing your Affidavit of Oath / Affirmation and Letter of Attestation from
the Accredited Attorney and Company will duly reimburse you of all the expenses you incurred only on sight of your valid legalization documents to show seriousness in joining the team not later than Five (5) working days after submission of employee’s expense report and receipts. The First six months upfront salaries shall be paid in advance before consultants/employee embark on journey to assume duty to enable you take care of pressing needs at your home country.
9 GOVERNING LAW
9.1 Due to the high rise of contract break up in Malaysia, the management has made it mandatory that every
prospective expatriate qualified to work in Malaysia must first procure an Affidavit of Oath / Affirmation and Letter of Attestation from the Malaysia High Court of Justice to legalize his / her contract and to also state that he / she will honor the terms of contract therein till the end of its duration before the management can go ahead and secure the Residence and Work Permit / Visa of the successful applicant; this is coming as a result of high rise in the number of employee’s that decamp their duty post and end their contract without prior notice to management. Procurement of this affidavit will further highlight you have accepted to honor the contract till its expiration; this Affidavit is obtainable only at the Malaysian High Court of Justice through an accredited attorney representing the applicant (Employee). I understand that I may voluntarily terminate my employment.
